About this Form

This lease agreement fully complies with the laws of the state of California. It is appropriate for use in a lease for term (such as an annual or multi-year lease), but one may also use it for a month-to-month tenancy. If the desired term is an annual or multi-year lease, please check the option under Paragraph 1(A), "Lease for Term." If the desired lease is a month-to-month tenancy, check the option under Paragraph 1(B), "Month-to-Month."


Governing Law

The landlord-tenant relationship and requirements for residential leasing in California are codified in Cal. Civil Code §§ 1940 - 1954.05 and § 1961 et seq.

Discrimination

The landlord may not inquire about the "immigration or citizenship status of a tenant, prospective tenant, occupant, or prospective occupant" (or require that he or she disclose or make any statement, representation, or certification concerning his or her immigration or citizenship status), according to Cal. Civil Code § 1940.3(b). Discrimination matters related to housing are further described in Cal. Gov't Code § 12955.

Security Deposit

  1. A residential tenancy security deposit in California may not exceed an amount equivalent to two (2) months' rent for an unfurnished property and three (3) months' rent for a furnished property.
  2. The state imposes no obligation on the landlord to pay interest to the tenant on the security deposit.
  3. The landlord must return the security deposit within 21 days after the tenant has vacated the premises. Cal. Civil Code § 1950.5(g).

Mandatory Disclosures

Among other requirements, a landlord is obligated by statute to disclose to the tenant:

  1. (1) information related to bed bug identification and the procedure to notify the landlord if the tenant discovers an infestation. Cal. Civil Code § 1954.603.
  2. (2) information related to hazards and whether the landlord has actual knowledge that the premises are located in a special flood hazard area or an area of potential flooding. Cal. Gov't Code § 8589.45.
